In 2009, I became extremely concerned with the concept of Unique Identity for various reasons. Connected with many like minded highly educated people who were all concerned.
On 18th May 2010, I started this Blog to capture anything and everything I came across on the topic. This blog with its million hits is a testament to my concerns about loss of privacy and fear of the ID being misused and possible Criminal activities it could lead to.
In 2017 the Supreme Court of India gave its verdict after one of the longest hearings on any issue. I did my bit and appealed to the Supreme Court Judges too through an On Line Petition.
In 2019 the Aadhaar Legislation has been revised and passed by the two houses of the Parliament of India making it Legal. I am no Legal Eagle so my Opinion carries no weight except with people opposed to the very concept.
In 2019, this Blog now just captures on a Daily Basis list of Articles Published on anything to do with Aadhaar as obtained from Daily Google Searches and nothing more. Cannot burn the midnight candle any longer.

Legal scholar Usha Ramanathan describes UID as an inverse of sunshine laws like the Right to Information. While the RTI makes the state transparent to the citizen, the UID does the inverse: it makes the citizen transparent to the state, she says.

Good idea gone bad
I have written earlier that UID/Aadhaar was a poorly designed, unreliable and expensive solution to the really good idea of providing national identification for over a billion Indians. My petition contends that UID in its current form violates the right to privacy of a citizen, guaranteed under Article 21 of the Constitution. This is because sensitive biometric and demographic information of citizens are with enrolment agencies, registrars and sub-registrars who have no legal liability for any misuse of this data. This petition has opened up the larger discussion on privacy rights for Indians. The current Article 21 interpretation by the Supreme Court was done decades ago, before the advent of internet and today’s technology and all the new privacy challenges that have arisen as a consequence.

Expressing discontentment over the Centre’s notification to make Aadhaar number mandatory for accessing subsidised food grains under the National Food Security Act (NFSA), members of the Right to Food Campaign (RFC) have demanded that such notifications be revoked.

RFC’s convener Kavita Srivastava said that on the February 8, the Ministry of Consumer Affairs, Food and Public Distribution made possession of an Aadhaar number mandatory for accessing subsidised food grains under the NFSA. Earlier, on February 6, the Ministry of Women and Child Development had issued a notification that made Aadhaar a must for Anganwadi workers and helpers. Last month, the Ministry of Rural Development made it mandatory for all MGNREGA workers to get Aadhaar numbers by March 31.

“These notifications are in blatant violation of Supreme Court orders which unequivocally make Aadhaar ‘purely voluntary’ till a final judgement is passed in the matter, and stand despite the passage of the Aadhaar Act of 2016,” she said, adding that apart from this disregard for the rule of law, the notifications betray the Centre’s unwillingness to learn from the experience of large-scale exclusion of people caused by making legally guaranteed services contingent upon producing an Aadhaar number.


‘Poor will be hit’
Ms. Srivastava pointed out that by making the Aadhaar mandatory, the Centre is effectively hitting out at the most vulnerable. “In the PDS specifically, data from Jharkhand and Rajasthan shows that up to 30% of beneficiaries are not being able to receive entitlements through the Aadhaar-linked biometric authentication system,” she said.

Ms. Srivastava said that while the need of the hour is to make these schemes accessible for all by removing any bottlenecks, making the UID mandatory only serves to exclude the poorest and most marginalised.

“Aadhaar system requires the Internet, electricity, a functional PoS machine, remote servers and sometimes mobile networks. We believe that access to food under the NFSA cannot be made dependent upon a system that requires multiple fragile technologies to work simultaneously and perfectly,” she added.

MUMBAI: Reliance Industries Ltd Chairman and Managing Director Mukesh Ambani on Wednesday said the company's newly-launched telecom venture Reliance Jio stands for affordability and data is the new oil in the industry.

"Jio was conceived at a time when the world was fast digitising. What the Jio platform offers is partner with the next generation to solve problems for India to make sure our industries are more productive," Ambani said.

"To my mind, data is the new natural resource. In that sense, India is blessed with 1.3 billion people, for it to have real value it has to be processed into intelligence. Data is the new oil and its benefit is immense to society. India with its young population will have a competitive advantage," he added.

He was speaking at an interactive session at the Nasscom India Leadership Forum 2017 here.

Reliance Jio has disrupted the Indian telecom industry with its free data offer till March.

"With the investment in Jio and concurrent action spurred in the industry, India can be among the top 10 in broadband access. Data is the oxygen of this digital life and no Indian should have this in scarcity," he added.

Ambani said human race is at the doorstep of fourth industrial revolution of convergence of digital and biological science. "At the foundation of fourth industrial revolution is connectivity and data, the convergence of all the sciences has been brought about."

Ambani said Aadhaar has enabled Reliance Jio to have millions of customers within few months.

Talking about digital payments, he said: "After the Aadhaar, you consider the digital payments system that is fast developing. Earlier, loans and financial resources were only available to a few people at high value. Now, I see that changing on the basis of technology. Now based on data, you can get a loan on your mobile phone."

"We are at the doorsteps of change in adapting technology to change the lives of people."

"In this new world in terms of digitisation it is important to be open. Whatever the world trends may be, we have to make sure we are always open, always connected. The goal of improving the lives of hundreds of millions of people is the opportunity that we have," he added.

Talking about digitisation, Ambani said: "We have opportunity to adapt artificial intelligence, natural language processing, drones in terms of our logistics. Opportunities are immense. Now we have infrastructure to do it in our own market and make India one of the biggest software markets"of the world."

Counselling a five-point tip-sheet for budding entrepreneurs and potential start-up founders, Ambani said it is essential to find a passion for solving a problem without focusing primarily on financial returns.

"As an entrepreneur, you find a solution to the problem you are passionate about. It is not solving problems but first finding problems and then solving it. Financial results are actually a by-product. Failures are normal. Learn from them.

"Two non-negotiables for me is treat investors' money even more carefully than your own money. You cannot do anything without the right team, align it passionately to your own mission. An entrepreneur is always optimist," he added.

During the Nasscom India Leadership Forum 2017 on Wednesday Reliance Industries Ltd Chairman and Managing Director Mukesh Ambani said the company's newly-launched telecom venture Reliance Jio has been able to acquire a million customers a day because of Aadhaar.

They have crossed 100 million customer base since it launched in September 2016. 

"When we started Jio we set a target of 100 million customers in shortest time. Even we didn't imagine we will do it in months. Aadhaar enabled us to acquire a million customers a day, which is unheard of in the industry," Ambani said.

However, the data sharing between the Central government and Reliance-Jio Private Limited has been contested in the Kerala High Court in December.

Jio sim can be activated within hours after the sim cards are authenticated with Aadhaar numbers. The company doesn't mention for how long the information would be retained.
The Kerala High Court had sent notices to the Central government, chairman of Unique Identification Authority of India (UIDAI), and Reliance-Jio Private Limited on a public interest writ petition filed by  Sunil TG, general secretary of Kerala Pradesh Youth Congress, according to the Hindu. 
According to the petition, as per the Aadhaar Act, all data collected by Aadhaar authority is meant to be protected in a permanent locking manner and can only be accessed by biometric authentication. 

However, Reliance Jio Private Limited is not the only company to use the eKYC process. Airtel and Vodafone are also listed as eKYC User Agency under UIDAI, allowing them to validate individual customer using biometrics and Aadhaar details. The process is believed to be faster, foolproof and will help avoid the misuse of sim cards. 

Here's a list of all eKYC User Agencies under UIDAI. However, the permission granted by the UIDAI and the Centre is in violation of the Adhaar (Target Delivery of Financial and Other Subsidies, benefits and Services) Act, 2016. 

The petitioner had sought a directive to the Cabinet Secretary and chairman of the UIDAI to show cause the authorising department for use of Aadhaar information by private companies. The petition also sought cancellation of permission given to Reliance-Jio Private Limited for authentication of data using Aadhaar.

“I would urge all of you, please read the Aadhaar act and the regulations,” UIDAI CEO Ajay Bhushan Pandey said at the India Digital Summit last week, adding “What the underlying theme is that we have presumed that privacy is…whether privacy is a fundamental right or not is a question which will be answered by the Supreme Court, finally.” 

Pandey was responding to a question from MediaNama, which pointed out the Union of India’s statement in the Supreme Court that ‘Violation of privacy doesn’t mean anything because privacy is not a guaranteed right’, and asked about privacy protections in the law to prevent mass surveillance of citizens.

Pandey added that “We’ve presumed that the privacy is almost like a fundamental right. And if a fundamental right has to be protected, what protection measures should be there? So, whenever the hearing takes place, we are going to take this stand in the Supreme Court, saying that whether the privacy is a fundamental right or not doesn’t concern only Aadhaar, it concerns many other aspects. But so far as Aadhaar is concerned, please test the Aadhaar act on that standard, saying that presume that Privacy is a fundamental right, and whether whatever Aadhaar is doing meets that fundamental right criteria or not. And we’re very sure.”

“Now the Aadhaar act has been passed, it is almost one year, and the way we’re doing it, all other apprehensions that government will become big brother, government will aggregate big data and all kinds of things, data will be misused, private companies will misuse it, all these things, you know all these things today, you know I wouldn’t say there are no complaints, but genuinely there are no specific instances”, and “Nor have such complaints have been brought to the notice of the court.”

Please note that Renuka Sane (visiting fellow at the IDFC Institute, Mumbai) and Vrinda Bhandari (Advocate at the Delhi High Court) had detailed out earlier issues related to privacy in the Aadhaar Act, saying that the Aadhaar Act and the IT Act are “important failures in enshrining privacy.” Read their detailed analysis here. Importantly, they also point out that there is a possibility of a conflict of Internet “since it may be in UIDAI’s interest to cover up breaches of privacy. Without the UIDAI’s proactive action, an individual Aadhaar number holder is left without remedy.”*

The other question we asked Pandey was about the failure rate, and “what recourse do people who have been denied their benefits, have? This concern about fingerprints was also raised by the parliamentary standing committee, under Yashwant Sinha

To this, Pandey said that “Ideally there should be no failure rate. But what is happening is that we’re seeing a failure rate of 92-98%…I mean success rate. What is that 8% or 2%? That is somebody who could not get authenticated.”

“Sometimes people are very innovative,” he added. “They try to see if their fingerprint works or not (for someone elses Aadhaar number). I’m not saying that that is the only reason. 

Sometimes, you know, some of the fingerprints are worn out. In that case, we have the facility that you can authenticate any of the fingerprints. 10 fingerprints or the iris. Using this you can reach almost near 100%. The telecom companies that have started given SIMs (SIM cards for mobile numbers) using this, their success rate is 98%. Whereas, the business correspondents, who go to the villages and actually hand out cash, have a success rate of 92%. They have to improve that.”

Frankly, even 2% and 8% failure rates are significantly large numbers when you consider a population of 1.2 billion on Aadhaar: it is real people who are getting impacted, and someone denied their rights – rations are critical for many – shouldn’t be seen as just a percentage point. That is one of the problems with the proponents of Aadhaar (and digital payments): a lack of empathy, and thinking of technology as the be-all and end-all of India’s problems.
