7780 - Cidco’s insistence on Aadhar card derails property deals - dna

If you do not have an Aadhaar card, you will find it difficult to buy or sell property in the City and Industrial Development Corporation’s (Cidco) jurisdiction.

The planning agency is insisting on an Aadhaar card from every buyer as well as seller while carrying out property-related transactions in its jurisdiction.

Ramesh Menon, a resident of sector 11 in Kharghar has already submitted a letter to Cidco’s  managing director Sanjay Bhatia, requesting him to understand the inconvenience caused to the residents. According to Menon, the property deal of his friend is on hold since the past two months as one of the buyers does not have an Aadhaar card. “We have completed all the required formalities (agreement of sale, paying stamp duty and registration charges, society transfer charges) to transfer the flat. However, the NOC from Cidco for transfer of flat is still pending as the buyer does not have an Aadahar card to submit.” 

Cidco cannot insist on Aadhaar cards, say lawyers
Vinod Sampat, a senior lawyer, said no government body can insist or make Aadhaar mandatory as per the Supreme Court’s order. The person who has been asked for Aadhaar card can approach the court as this is an attempt of contempt of the apex court’s order.

On September 23, 2013, the SC had directed all the states and central government that no person should suffer due to lack of Aadhaar card, despite the issuing of a circular that made the card mandatory.

Later on March 16, 2015, the three-judge bench of SC, headed by Justice Jasti Chelameswar, reiterated that the court expects the government to adhere to the order dated September 23, 2013.

Cidco officials, however say that the inclusion of the Aadhaar card makes the procedures easier for them. Sanjay Bhatia, Cidco's MD, said, “Other identification cards can work. But in the absence of Aadhaar card, we will have to take that person’s biometrics too. If the person submits an Aadhaar card, then he does not need to go through the process of biometrics.”
