In 2009, I became extremely concerned with the concept of Unique Identity for various reasons. Connected with many like minded highly educated people who were all concerned.
On 18th May 2010, I started this Blog to capture anything and everything I came across on the topic. This blog with its million hits is a testament to my concerns about loss of privacy and fear of the ID being misused and possible Criminal activities it could lead to.
In 2017 the Supreme Court of India gave its verdict after one of the longest hearings on any issue. I did my bit and appealed to the Supreme Court Judges too through an On Line Petition.
In 2019 the Aadhaar Legislation has been revised and passed by the two houses of the Parliament of India making it Legal. I am no Legal Eagle so my Opinion carries no weight except with people opposed to the very concept.
In 2019, this Blog now just captures on a Daily Basis list of Articles Published on anything to do with Aadhaar as obtained from Daily Google Searches and nothing more. Cannot burn the midnight candle any longer.

Aadhaar

The UIDAI has taken two successive governments in India and the entire world for a ride. It identifies nothing. It is not unique. The entire UID data has never been verified and audited. The UID cannot be used for governance, financial databases or anything. It’s use is the biggest threat to national security since independence. – Anupam Saraph 2018

When I opposed Aadhaar in 2010 , I was called a BJP stooge. In 2016 I am still opposing Aadhaar for the same reasons and I am told I am a Congress die hard. No one wants to see why I oppose Aadhaar as it is too difficult. Plus Aadhaar is FREE so why not get one ? Ram Krishnaswamy

“The invasion of privacy is of no consequence because privacy is not a fundamental right and has no meaning under Article 21. The right to privacy is not a guaranteed under the constitution, because privacy is not a fundamental right.” Article 21 of the Indian constitution refers to the right to life and liberty -Attorney General Mukul Rohatgi

“There is merit in the complaints. You are unwittingly allowing snooping, harassment and commercial exploitation. The information about an individual obtained by the UIDAI while issuing an Aadhaar card shall not be used for any other purpose, save as above, except as may be directed by a court for the purpose of criminal investigation.”-A three judge bench headed by Justice J Chelameswar said in an interim order.

Legal scholar Usha Ramanathan describes UID as an inverse of sunshine laws like the Right to Information. While the RTI makes the state transparent to the citizen, the UID does the inverse: it makes the citizen transparent to the state, she says.

Good idea gone bad
I have written earlier that UID/Aadhaar was a poorly designed, unreliable and expensive solution to the really good idea of providing national identification for over a billion Indians. My petition contends that UID in its current form violates the right to privacy of a citizen, guaranteed under Article 21 of the Constitution. This is because sensitive biometric and demographic information of citizens are with enrolment agencies, registrars and sub-registrars who have no legal liability for any misuse of this data. This petition has opened up the larger discussion on privacy rights for Indians. The current Article 21 interpretation by the Supreme Court was done decades ago, before the advent of internet and today’s technology and all the new privacy challenges that have arisen as a consequence.

But Aadhaar has been mythologised during the previous government by its creators into some technology super force that will transform governance in a miraculous manner. I even read an article recently that compared Aadhaar to some revolution and quoted a 1930s historian, Will Durant.Rajeev Chandrasekhar, Rajya Sabha MP

In the Supreme Court, Meenakshi Arora, one of the senior counsel in the case, compared it to living under a general, perpetual, nation-wide criminal warrant.

Had never thought of it that way, but living in the Aadhaar universe is like living in a prison. All of us are treated like criminals with barely any rights or recourse and gatekeepers have absolute power on you and your life.

6014 - From Jan 1, even if you don’t have Aadhaar card, you can avail LPG subsidy - Indian Express

Express News Service | Chandigarh | Posted: November 15, 2014 4:47 am

A modified direct benefit transfer scheme for LPG (DBTL) consumers, under which the subsidy will be given even to consumers who do not have the Aadhaar card, will be launched in the Tricity on January 1, 2015.

In order to become cash transfer compliant, LPG consumers who have an Aadhaar number have to provide the number to their LPG distributor and the bank on prescribed forms.
LPG consumers who had joined the scheme earlier by linking their Aadhaar number in the LPG and bank database do not have to do anything further. They can check their CTC status on http://www.mylpg.in.

Those consumers who do not have an Aadhaar number will have to give the bank details to the LPG distributor, or their 17-digit LPG ID to the bank, using prescribed forms.

After January 1, the consumers will be given a three-month grace period to complete the formalities, but they will continue to get cylinders at the market rate. If a consumer joins the scheme within this period, the subsidy according to the entitlement and consumption during this time will be transferred to his or her bank account.

Those who fail to join the scheme in three months will get LPG cylinders at the market rate.

Under DBTL, the consumers will be given a ‘permanent advance’ subsidy of Rs 435 as soon as they make the first booking of a cylinder. The advance will be given directly in the bank account before the delivery.

The advance ensures that LPG consumers have extra cash to pay for their first LPG cylinder at the market price. The permanent advance will be notified for the consumers now joining the scheme separately.

After the consumer takes delivery of the cylinder, another advance cash subsidy will be transferred to the bank account. The subsidy will be given for each supplied cylinder, subject to the consumer’s entitlement.

6006 - Centre to relaunch Aadhaar-linked LPG scheme from tomorrow - Business Standard

New schemes allows consumers without Aadhaar to receive cash directly in their bank accounts

BS Reporter  |  New Delhi  November 14, 2014 Last Updated at 17:56 IST

The government is to launch the modified version of the Direct Benefit Transfer scheme (DBT) for Liquefied Petroleum Gas (LPG) in 54 districts across the country from tomorrow.

The government hopes to cut down on large scale diversion of subsidised domestic cooking gas that does not make Aadhaar number mandatory.

Earlier version of the scheme that was rolled out by the previous UPA government in June 2013 had to be stopped after the Supreme Court observed that Aadhaar numbers cannot be made mandatory for for availing the scheme. By that time, the scheme was already rolled out in 292 districts.

"In the 54 Districts covering 11 states, the scheme will cover 2.33 crore households. Currently, the Aadhaar generation level in these districts is 95%," said an official release.

Under the new scheme, consumers without Aadhaar numbers can receive cash directly in their bank accounts. However, they may have to shift to Aadhaar-based cash transfer when they get Aadhaar.

Also, consumers who are not Cash Transfer Compliant (CTC) will get a three-month grace period during which they will receive the cylinders at subsidised rates. After the grace period lapses, they will get an additional parking period of three months after which they will have to buy cylinders at the market rate that is non-subsidised rate.

If the consumer joins the scheme within the Parking Period, the subsidy as per entitlement and consumption during Parking Period will be transferred to their bank account.

In order to ensure the LPG consumers have extra cash to pay for the first LPG cylinder at market price, a permanent advance will be paid to consumers as soon as they make the first booking for a cylinder after joining the scheme.

The government requested the consumers to get their Aadhaar numbers linked with LPG distributors and banks. Consumers without the numbers need to either give their bank account details to the Oil Marketing Company (OMC) distributoror or give their 17-digit LPG identification number to their banks.

Under the new scheme, consumers will receive text messages at every stage of enrollment in the scheme.

"We have already sent over 3 crore messages to consumers. We want to ensure smooth running of the scheme in the first phase before its nationwide rollout by January 2015," saida senior petroleum ministry official.

The proposal to restart DBT in LPG was part of the official announcement at the launch of Prime Minister's Jan Dhan Yojana in August. Under the previous avatar of DBT-LPG scheme, the government had transacted over Rs 5,000 crore to beneficiaries using Aadhaar

5934 - Modified Direct Benefit transfer scheme to be relaunched in the country - TNN

Manjiri Damle, TNN | Oct 31, 2014, 04.36PM IST

PUNE: The union government has approved the Modified Direct Benefit Transfer Scheme in LPG being re-launched in 54 districts from mid-November, 2014 and in rest of country from January next year.

The government has revisited the scheme design and processes and after thorough review, it has approved the Modified DBTL which will alleviate the hardships of the LPG consumers faced by them in the earlier scheme. The subsidy per domestic subsidized cylinder shall be fixed. LPG consumers who join the modified DBTL scheme in future can receive LPG cash subsidy by linking Aadhaar number to the LPG and bank database as the primary option. Also they can receive subsidy directly into the bank account without necessarily linking it with the use of Aadhaar as the secondary option. This will ensure that no consumer is denied LPG subsidy for want of Aadhaar number.
All LPG consumers who had already joined the scheme solely based on Aadhaar number will start getting subsidy in their Aadhaar linked bank accounts after scheme is launched. LPG consumers will get a Grace Periodof 3 months during which consumers who have joined the scheme will get subsidy in bank account and others will continue to get cylinders at subsidized price.

LPG consumers who do not join the scheme after the 3 month grace period, will be eligible for an additional subsidy Parking Periodof 3 months. During this period, LPG cylinders to all such consumers will be supplied at market price, but the subsidy due on all LPG supplies will be credited to the bank account as soon as consumer joins the scheme in this period and as per entitlement.

5919 - Now, a modified DBT scheme for LPG refill - Deccan herald

P M Raghunandan, Bangalore, Oct 28, 2014, DHNS :

State-owned oil marketing companies – IOC, BPC and HPC – are all set to roll out a modified Direct Benefit Transfer (DBT) scheme for LPG refills in Mysore and Tumkur districts from November 10.

The modified scheme will not be linked to Aadhaar numbers, but will work purely based on bank accounts. The subsidy component of the LPG refill will be credited directly to the consumers’ bank accounts.

However, oil companies have decided to continue supplying LPG refill to consumers who already have Aadhaar-based bank accounts, said Dilip Rai, General Manager (LPG), IOC.

The previous Congress-led UPA government had launched the Aadhaar-based DBT in June 2012 on a pilot basis in Mysore and Tumkur districts, where Aadhaar coverage was more than 80 per cent.

In March 2013, the scheme was discontinued following the Supreme Court judgement that unique identity numbers should not be made mandatory for availing government services. The NDA government modified the scheme, delinking it from Aadhaar.

In fact, the recently launched Jan Dhan Yojana, which envisages opening at least one bank account to every family, is expected to provide a shot in the arm to the modified DBT.

Oil companies have been struggling to bring consumers in rural areas under the Aadhaar-based DBT, official sources said. Also, the glitch is that neither oil companies nor banks have authentic data on the number of families that do not have bank accounts.

The State-level bankers’ committee has now undertaken a survey as part of Jan Dhan Yojana to identify families that do not have bank accounts.

How it works

Under the modified scheme, consumers only have to approach any of the banks, including private ones, and obtain a bank mandate for DBT. Once they submit the filled-in bank mandate to the distributor, she/ he will get registered under the new system.

The oil companies will deposit the subsidy component in the bank account soon after a consumer applies for LPG refill, Rai said. LPG consumers in Mysore and Tumkur will be given three months to register under the new system, from the date of launch.

Unlike the previous Aadhaar-based DBT, consumers who fail to register within three months will not lose out the subsidy on refill. While charging the complete cost of a refill, oil companies will park the subsidy component of such consumers in a separate account. The accumulated subsidy amount will be deposited in the bank account the moment a consumer comes under the scheme, he added.

Official sources said that the modified scheme is likely to be extended across the State from January 1, 2015. Preparations are already underway.
