In 2009, I became extremely concerned with the concept of Unique Identity for various reasons. Connected with many like minded highly educated people who were all concerned.
On 18th May 2010, I started this Blog to capture anything and everything I came across on the topic. This blog with its million hits is a testament to my concerns about loss of privacy and fear of the ID being misused and possible Criminal activities it could lead to.
In 2017 the Supreme Court of India gave its verdict after one of the longest hearings on any issue. I did my bit and appealed to the Supreme Court Judges too through an On Line Petition.
In 2019 the Aadhaar Legislation has been revised and passed by the two houses of the Parliament of India making it Legal. I am no Legal Eagle so my Opinion carries no weight except with people opposed to the very concept.
In 2019, this Blog now just captures on a Daily Basis list of Articles Published on anything to do with Aadhaar as obtained from Daily Google Searches and nothing more. Cannot burn the midnight candle any longer.

Aadhaar

The UIDAI has taken two successive governments in India and the entire world for a ride. It identifies nothing. It is not unique. The entire UID data has never been verified and audited. The UID cannot be used for governance, financial databases or anything. It’s use is the biggest threat to national security since independence. – Anupam Saraph 2018

When I opposed Aadhaar in 2010 , I was called a BJP stooge. In 2016 I am still opposing Aadhaar for the same reasons and I am told I am a Congress die hard. No one wants to see why I oppose Aadhaar as it is too difficult. Plus Aadhaar is FREE so why not get one ? Ram Krishnaswamy

“The invasion of privacy is of no consequence because privacy is not a fundamental right and has no meaning under Article 21. The right to privacy is not a guaranteed under the constitution, because privacy is not a fundamental right.” Article 21 of the Indian constitution refers to the right to life and liberty -Attorney General Mukul Rohatgi

“There is merit in the complaints. You are unwittingly allowing snooping, harassment and commercial exploitation. The information about an individual obtained by the UIDAI while issuing an Aadhaar card shall not be used for any other purpose, save as above, except as may be directed by a court for the purpose of criminal investigation.”-A three judge bench headed by Justice J Chelameswar said in an interim order.

Legal scholar Usha Ramanathan describes UID as an inverse of sunshine laws like the Right to Information. While the RTI makes the state transparent to the citizen, the UID does the inverse: it makes the citizen transparent to the state, she says.

Good idea gone bad
I have written earlier that UID/Aadhaar was a poorly designed, unreliable and expensive solution to the really good idea of providing national identification for over a billion Indians. My petition contends that UID in its current form violates the right to privacy of a citizen, guaranteed under Article 21 of the Constitution. This is because sensitive biometric and demographic information of citizens are with enrolment agencies, registrars and sub-registrars who have no legal liability for any misuse of this data. This petition has opened up the larger discussion on privacy rights for Indians. The current Article 21 interpretation by the Supreme Court was done decades ago, before the advent of internet and today’s technology and all the new privacy challenges that have arisen as a consequence.

In the Supreme Court, Meenakshi Arora, one of the senior counsel in the case, compared it to living under a general, perpetual, nation-wide criminal warrant.

Had never thought of it that way, but living in the Aadhaar universe is like living in a prison. All of us are treated like criminals with barely any rights or recourse and gatekeepers have absolute power on you and your life.

13678 - Jharkhand, where not having Aadhaar could starve you to death - The Hindu

Around half-a-dozen people have allegedly died of starvation in Jharkhand in the last six months. Most of them were reportedly denied rations from the Public Distribution System shops for failing to have Aadhaar-based biometric authentication. Two women — one in Giridih and the other in Chatra district — died of alleged starvation last week, prompting Chief Minister Raghuvar Das to order a probe. The government reports said the women were sick; family members claimed they died of hunger.

What happened?
On June 2, Savitri Devi, 58, from Mangragarhi village in the Dumri block of Giridih district, allegedly died of hunger. Family members and villagers said she had nothing to eat at home. She was denied rations from PDS shops because her ration card could not be linked with Aadhaar. On June 4, Meena Musahar, 45, from the Prem Nagar area in the Itkhori block of Chatra district, allegedly died of starvation. Her son said his mother died of hunger; the government said it was awaiting the autopsy report to ascertain the exact cause of death. Recently, Lakhi Murmu, Santoshi Kumari, Ruplal Marandi, Premani Kunwar and Etwariya Devi, too, reportedly died of hunger in different districts. All these deaths took place after the State government cancelled 11.6 lakh ration cards, saying they were not linked to Aadhaar.

Why didn’t they have ration cards?
The ration cards of Savitri Devi and many others were cancelled because they did not have Aadhaar linkage. They were unable to procure food after the Aadhaar-enabled point of sales (PoS) machine could not authenticate their biometrics. Dumri Block Development Officer (in-charge) Rahul Dev confirmed that Savitri Devi did not have a ration card. Village head Ram Prasad Mahto said Savitri Devi was not getting foodgrains from PDS shops as her ration card was cancelled. Till January, of the 2.3 crore people in Jharkhand covered under the PDS, only 1.7 crore had Aadhaar linkage.

Why the Aadhaar-PDS link?
Though the Supreme Court has said Aadhaar linkage is voluntary, at the village and panchayat levels in Jharkand, little appears to have changed. For a person who gets foodgrains through the PDS, it is mandatory for him or her to follow the Aadhaar-Based Biometric Authentication (ABBA) system that is the practice of using an electric point of sale (PoS) machine for each transaction. For implementing the ABBA system, it is necessary to have Aadhaar seeding, which is to get one’s Aadhaar number linked to the ration card.

What are the hurdles?
To get benefits under the PDS, biometric authorisation is required and this calls for technological necessities which villages lack: uninterrupted power supply, a functioning PoS machine, adequate mobile and Internet connectivity and ensuring that data repository servers are running smoothly. So, every time a person has to get rations from a PDS shop, he/she has to pray that all these variables work.

What is the government doing?
The government says it has begun rechecking the details of those left out of the Aadhaar linkage, but officials admit the process is moving at a slow pace.
The government has made Aadhaar seeding compulsory but many tribals, unaware of this requirement, are denied access to food. The government feels that by linking ration cards to Aadhaar, it will remove the corruption in the PDS system. The government has also announced that it has achieved 100% Aadhaar seeding but experts said lakhs of people covered by the PDS are not linked with their Aadhaar numbers.

What lies ahead?

The government has to take foolproof measures for seeding of Aadhaar numbers, say experts like Jean Dreze. Food, Public Distribution and Consumer Affairs Minister Saryu Rai says his Department has proposed to set up grain banks in blocks and panchayats to help those in need.

Her family has claimed that “no food was cooked in the house since at least three days before she died”.

The Jharkhand government has rejected the claims of the family of an old woman in Giridih district who allegedly died due to starvation. The BJP government led by Chief Minister Raghubar Das has cited medical and bank records to deny reports and said that the woman had Rs 2,375 in her bank account, according to The Indian Express. “Every death is sad but there should be no politics on it. Before arriving at any conclusion, the facts should be inquired into first. We are all saddened by the death of sister Savitri Devi, but the inquiry report clearly establishes that the death was not due to hunger,” the Chief Minister’s Office (CMO) stated.

Officials further said that Devi was suffering from parenchymal haematoma, or bleeding inside the brain. She was even treated at the Rajendra Institute of Medical Sciences (RIMS) in Ranchi.
Following the death, it was reported that the woman did not have a ration card to procure foodgrains. Local officials are yet to ascertain why the 58-year-old’s family did not possess a ration card. Her family has claimed that “no food was cooked in the house since at least three days before she died”. The details of Devi’s bank account were ascertained only after officials updated the passbook after she died, according to the IE report.
Chainpur panchayat mukhiya, Ram Prasad Mahato, said: “Savitri Devi had come to me two-three months ago to ask about her widow pension for which she was eligible in 2014. I checked and realised that her bank account was not linked with her Aadhaar. I got that done. On April 4, Rs 1,800 — pension for three months — was credited into her account. But she never checked her passbook. I came to know that she had that money in her account only after it was updated — after her death.” Mahato has earlier confirmed to PTI that the family of the deceased neither had a ration card nor an old age pension facility.

Villagers found her dead on Sunday. Savitri’s husband had passed away 10 years ago and her two sons have migrated to Uttar Pradesh and Maharashtra to earn a living, according to the report. In December last year, 67-year-old Etwariya Devi from Sonpurwa village of Garhwa district died of hunger after her family was unable to procure food after the Aadhaar-enabled point of sales (PoS) machine could not authenticate biometrics of her daughter-in-law.

13661 - CONG WANTS ROY TO QUIT OVER STARVATION DEATHS - Daily Pioneer

Wednesday, 06 June 2018 | Parvinder Bhatia | Jamshedpur | in Ranchi

Addressing media this afternoon at the district party headquarter in Bistupur, the senior leader said that 11 persons have died of hunger since September 2017 in different parts of the State mostly due to failure in getting food grains under public distribution system (PDS).State Congress president Ajoy Kumar on Tuesday demanded resignation of state food and civil supplies minister, Saryu Roy over starvation deaths in different parts of the state since last year.

“It is a matter of great concern that the state government failed in execution of public distribution system. From the data  collected by us from independent sources, out of the 11 hunger deaths since September last year in five cases the victims’ family did not have a ration card.  In one case the family’s ration card was cancelled as it was not linked with Aadhaar.  In four cases the family could not access ration due to the mandatory requirement of Aadhaar-based biometric authentication for accessing PDS foodgrains,” said the IPS turned politician.

He went on to add that according to government’s own data, at least 10-20 % households (around 6-11 lakh households) are denied their grains every month due to Aadhaar-based biometric authentication. In one case the victim did not receive her pension as it was getting credited in someone else’s bank account linked with her Aadhaar. The victim was also denied her PDS foodgrains even though she successfully authenticated herself through Aadhaar-based biometric authentication. Most of the families could not get employment under MGNREGA. No action has been taken on erring officials and functionaries he noted.

“Moreover, in June itself there have been two deaths in Giridih and Chatra due to starvation. We demand resignation of the state food and civil supplies minister and criminal proceedings against all officials whose lapses have led to the starvation deaths,” said Ajoy Kumar.

The Congress leader also asked the state government to make public the actions taken by the committee constituted by the government in March this year to probe into starvation deaths and provide policy recommendations for avoiding hunger and went to demand immediate termination of Aadhaar-based biometric authentication for accessing foodgrains, social security pensions and all other welfare entitlements.

13650 - No Food For 3 Days, Jharkhand Woman Allegedly Dies Of Starvation - NDTV

A woman in Jharkhand died allegedly due to starvation, daughter says officials ignored repeated requests for a ration card
All India | Edited by Debjani Chatterjee (With inputs from agencies) | Updated: June 04, 2018 13:58 IST

Woman in Jharkhand's Giridih died allegedly due to starvation,
GIRIDIH, JHARKHAND:

58-year-old Savitri Devi had nothing to eat for three days, reportedly because she didn't have a ration card that helps the poorest access cheaper food. She allegedly starved to death on Sunday at Giridih in Jharkhand.

"Due to the negligence of authorities, her ration card could not be made, which is why she was unable to get food," a district official Sheetal Prasad told news agency ANI.

Savitri Devi's daughter-in-law Saraswati Devi said even after repeated requests for a ration card no one in the administration bothered. "She had no food since last three days...it became worse because we could not contact her," said Saraswati Devi.

Her two sons somehow manage to earn their living doing odd jobs and they often had to beg for food from villagers said neighbours. It is not clear how old Savitri Devi's sons are or if they lived with her.

On hearing of an alleged starvation death in his constituency, the lawmaker representing Dumri, Jagarnath Mahto said that the "matter was of great concern." Mr Mahato blamed negligence of officials but did not specify what action will be taken against officers who deprived Savitri Devi of a ration card. The lawmaker said the issue would be raised in the state assembly

Around six months ago, in neighbouring Uttar Pradesh, Shakina Ashfaq, a resident of Bareilly died allegedly due to starvation. The 50-year-old woman had not eaten for five days. Her family was allegedly denied of their monthly quota of cheaper food-grain because Shakina, who was paralysed, could not be present at the ration shop for her fingerprint authentication for Aadhaar.

The Yogi Adityanath government had said initial inquiries suggested Shakina died of an illness, not starvation. Shakina was a cardholder of the Antodaya Anna Yojana, a scheme for the poorest of the poor.

After Shakina's death, the Union food ministry in a statement had said the Centre was fully aware of challenges in the transition to the point of sale-based Aadhaar authentication system in the public distribution system. The states have been asked not to deny ration to the poor, the centre had said.

RANCHI: In yet another incident of hunger death in Jharkhand, 58 year old Savitri Devi died of hunger at Mangargarhi village in Giridih district of Jharkhand on Saturday. Villagers claimed that she had nothing to eat in her home as she was being denied ration from Public Distribution System (PDS) shop since 2012 after her ration card was cancelled as it could not be verified with Aadhar Card.

Savitri’s husband died 10 years back and her two sons have migrated to Uttar Pradesh and Maharashtra to earn their living. Though she died on Saturday, the villagers found it on Sunday.
“Shavitri Devi died of hunger as she was hungry for at least 3 days as she had nothing to cook in her house. In spite of completing all formalities, she could not be issued a ration card,” said Mukhia of Chainpur Panchayat Ramprasad Mahto.

The Block Development Officer (BDO) visited her house and claimed that she died of illness and not of hunger, he added.
Remarkably, around half a dozen of people allegedly died in the last few months across Jharkhand after having been denied ration from their PDS dealers for failing to verify themselves with Aadhaar.

Recently, Lakhi Murmu (30) of Dhowadnagal village under Hiranpur block of Pakur died on January 24 after she was denied food grains under PDS scheme for the past four months resulting in her starvation death. Earlier also, 11-year old Santoshi Kumari, a dalit girl from Karimati village in Simdega died of starvation after her family’s ration card was cancelled for not being linked to their Aadhaar number.
