In 2009, I became extremely concerned with the concept of Unique Identity for various reasons. Connected with many like minded highly educated people who were all concerned.
On 18th May 2010, I started this Blog to capture anything and everything I came across on the topic. This blog with its million hits is a testament to my concerns about loss of privacy and fear of the ID being misused and possible Criminal activities it could lead to.
In 2017 the Supreme Court of India gave its verdict after one of the longest hearings on any issue. I did my bit and appealed to the Supreme Court Judges too through an On Line Petition.
In 2019 the Aadhaar Legislation has been revised and passed by the two houses of the Parliament of India making it Legal. I am no Legal Eagle so my Opinion carries no weight except with people opposed to the very concept.
In 2019, this Blog now just captures on a Daily Basis list of Articles Published on anything to do with Aadhaar as obtained from Daily Google Searches and nothing more. Cannot burn the midnight candle any longer.

Aadhaar

The UIDAI has taken two successive governments in India and the entire world for a ride. It identifies nothing. It is not unique. The entire UID data has never been verified and audited. The UID cannot be used for governance, financial databases or anything. It’s use is the biggest threat to national security since independence. – Anupam Saraph 2018

When I opposed Aadhaar in 2010 , I was called a BJP stooge. In 2016 I am still opposing Aadhaar for the same reasons and I am told I am a Congress die hard. No one wants to see why I oppose Aadhaar as it is too difficult. Plus Aadhaar is FREE so why not get one ? Ram Krishnaswamy

“There is merit in the complaints. You are unwittingly allowing snooping, harassment and commercial exploitation. The information about an individual obtained by the UIDAI while issuing an Aadhaar card shall not be used for any other purpose, save as above, except as may be directed by a court for the purpose of criminal investigation.”-A three judge bench headed by Justice J Chelameswar said in an interim order.

Legal scholar Usha Ramanathan describes UID as an inverse of sunshine laws like the Right to Information. While the RTI makes the state transparent to the citizen, the UID does the inverse: it makes the citizen transparent to the state, she says.

Good idea gone bad
I have written earlier that UID/Aadhaar was a poorly designed, unreliable and expensive solution to the really good idea of providing national identification for over a billion Indians. My petition contends that UID in its current form violates the right to privacy of a citizen, guaranteed under Article 21 of the Constitution. This is because sensitive biometric and demographic information of citizens are with enrolment agencies, registrars and sub-registrars who have no legal liability for any misuse of this data. This petition has opened up the larger discussion on privacy rights for Indians. The current Article 21 interpretation by the Supreme Court was done decades ago, before the advent of internet and today’s technology and all the new privacy challenges that have arisen as a consequence.

In the Supreme Court, Meenakshi Arora, one of the senior counsel in the case, compared it to living under a general, perpetual, nation-wide criminal warrant.

Had never thought of it that way, but living in the Aadhaar universe is like living in a prison. All of us are treated like criminals with barely any rights or recourse and gatekeepers have absolute power on you and your life.

13080 - Aadhaar and Income-Tax Returns: Legal Notes by Arvind Datar 0

Aadhaar and Income-Tax Returns: Legal Notes by Arvind Datar

Arvind P. Datar

On March 13, 2018, the deadline for linking Aadhaar with bank accounts, mobile numbers, etc. was extended by the Supreme Court till the pronouncement of the judgment. However, there was no specific mention of income tax returns or PAN.

The question that is repeatedly being asked is How do persons who have chosen not to apply for Aadhaar file their income-tax returns?

In Binoy Viswam v. Union of India [(2017) 7 SCC 59 at para 133], the Supreme Court has made it clear that persons who have chosen not to enroll for Aadhaar will not face the consequences of their PAN number being deemed to be invalid as this would make it impossible for such persons to carry out banking transactions, sale and purchase of motor vehicles, shares, mutual funds etc as prescribed in Rule 114B of the Income-tax Rules, 1962. The net result is that, pending the decision in the main Aadhaar case, assessees who did not have the Aadhaar number could file returns and ensure that their PAN numbers did not become invalid.

However, the income-tax returns have now to be filed electronically and require the quoting of the Aadhaar number. Thus, persons who have chosen not to apply for Aadhaar will not be able to upload the return electronically despite the fact that application for Aadhaar is voluntary.

Manual return to be filed:
As per the interim orders of the Gujarat and Kerala High Courts, assessees can file their return manually without insisting on Aadhaar number/enrollment number. The cases are:
  • Bandish Saurabh Soparkar v. Union of India, [2017] 87 taxmann.com 48 (Gujarat); and
  • Prasanth Sugathan v. Union of India, [2017] 84 taxmann.com 73 (Kerala).
It must be pointed out that the Madras High Court, in Thiagarajan Kumararaja v. Union of India 398 ITR 740 (Mad), has dismissed a writ petition on the ground that the partial stay by the Supreme Court was only to facilitate the transactions mentioned in Rule 114B of the Income-tax Rules, 1962. The decision of the Madras High Court is, it is humbly submitted, erroneous, as the partial stay was intended not to prejudice persons who did not have Aadhaar cards or had not enrolled for the Aadhar number. This stay was also necessary in view of the main Aadhaar matter pending before the Constitution bench, and the judgment specifically mentions that the issues of privacy were being left open to be dealt with by the Constitution Bench (this was later referred to a nine judge Bench).
The views of the 9 judge Bench in Puttaswamy have now been relied upon in support of the view that compulsory linking of Aadhaar to PAN is unconstitutional, and arguments to this effect have been made in the pending matter before the Constitution Bench. The Madras High Court failed to note that if all eligible persons had to get Aadhaar number, the grant of the partial stay would be totally meaningless. The decision of the Madras High Court is thus contrary to the Supreme Court decision. Further, the decision of the Madras High court is being appealed against. The views taken by the Gujarat and Kerala High Courts are in harmony with the views and the partial stay granted by the Supreme Court.
It is, therefore, suggested that persons who do not have Aadhaar should adopt the following steps:
  1. The income-tax returns should be filled up manually;
  2. The return should be filed before the Jurisdictional Assessing Officer with a covering letter stating that they have chosen not to enroll for Aadhaar and that the return cannot be uploaded electronically without Aadhaar number. Consequently, they have no option but to file it manually; and
  3. Such manual filing has been permitted by the Gujarat and Kerala High Courts.
It is also hoped that the CBDT issues a circular that enables the filing of manual returns till the Aadhaar judgment is pronounced.

Over 11,56000 PAN de-activated: Govt

The government today informed the Lok Sabha that over 11 lakh 56 thousand Permanent Account Numbers have been de-activated so far. The process of de-activation of additional PAN cards allotted to taxpayers is going on.

In a written reply, Minister of State for Finance Jayant Sinha said that the seeding of Aadhaar cards in PAN database has started on a voluntary basis. This will help curb the duplicate PAN allotments. He said addition of mother’s name in the PAN database will also help in identifying duplicate PAN cards.

9197 - PFRDA switches to PAN from Aadhaar for online enrolment under NPS

PTI|

20 Dec, 2015, 11.25AM IST

NEW DELHI: Pension fund regulatory body PFRDA has started using PAN instead of Aadhaar for validation of new customers who can now be registered online under the National Pension System (NPS) scheme.

"PAN (permanent account number) cards will be used instead of Aadhaar for online opening of an NPS account. An online facility for opening of an NPS account based on verification of PAN and bank KYC has commenced," Pension Fund Regulatory and Development Authority of India (PFRDA) Chairman Hemant G Contractor told PTI.

The Aadhaar-based online NPS account facility was started on a pilot basis, but following a Supreme Court judgment on usage of Aadhaar, it had to be discontinued.

He said under the PAN validated facility, customers can access their account on the NPS Trust website.

"The subscriber having an account with Internet banking facility with any of the six participating banks can open his NPS account online," Contractor said.

The banks in question are State Bank of Travancore, State Bank of Patiala, Oriental Bank of Commerce, United Bank of IndiaBSE -1.40 %, South Indian BankBSE -0.26 % and Syndicate BankBSE 0.37 %.

The Supreme Court in October lifted restrictions on usage of Aadhaar card for social welfare schemes and said implementing agencies can use Aadhaar number voluntarily.

Contractor said the apex court has allowed usage of Aadhaar for the pension scheme under the National Social Assistance Programme (Old Age Pensions, Widow Pensions, Disability Pensions), apart from MGNREGS, PMJDY and EPFO.

While the online facility is expected to widen PFRDA's reach, people may stand to gain from quicker replies.

NPS, regulated by PFRDA, has a wide spectrum of subscribers drawn from central, state, private and unorganised sectors.

According to PFRDA data, as of October 31, 2015, a total of 9,380,174 were on the subscriber list of NPS. The asset under management during the same period stood at Rs 1,02,878 crore.

7823 - Get PAN card with Aadhaar or voter ID - Telegraph India

New Delhi, April 20 (PTI): An elector's photo identity card or Aadhaar will now be enough to obtain PAN cards, with the Centre relaxing cumbersome procedures requiring multiple documents.

Till now, the EPIC (voter card) and Aadhaar cards were only considered proof of identity and address, not age. The change was made through a notification by the Central Board of Direct Taxes, which oversees the income-tax department that issues PAN cards.

"The new notification means that, henceforth, having an EPIC or Aadhaar will be enough to obtain the PAN card. The two documents will be valid as proof of an individual's identity, address and date of birth.... The EPIC and Aadhaar are now unique and all-purpose identifiers," a tax official said.

The new notification also lists some other documents that will be accepted as age proof. These include a "photo identity card issued by the central government or state government or central public sector undertaking or state public sector undertaking or the central government health service scheme photo card or ex-servicemen contributory health scheme photo card".

"So, effectively now, there are a total of 12 identity documents which could be used to establish the date of birth of an individual applying for a PAN card compared to eight earlier. But for a common man, who is not in government service, only an EPIC or Aadhaar is required," the tax officer said.

He said the Centre was on a mission to bring the three unique identifiers - EPIC, Aadhaar and PAN - on one platform and link their databases. The aim is to thwart duplicity or forgery in any of the documents essential to get the benefits of central schemes.

7822 - Now EPIC or Aadhaar document enough to get PAN card - Indian Express

By: Press Trust of India | New Delhi | Published on:April 20, 2015 11:18 pm

An EPIC or Aadhaar document will now be enough for any individual to obtain PAN card as the Income Tax Department has relaxed the cumbersome procedure of having multiple documents to prove one’s own identity.

The Central Board of Direct Taxes (CBDT), the apex policy making body of the I-T Department, has recently issued a notification making the Elector’s Photo Identity Card (EPIC) and Aadhaar, issued by the Unique Identification Authority of India, valid proof of “date of birth” for obtaining PAN card.

Till now, both these photo ID cards were only considered as valid proof for substantiating the “identity” and “address” of an individual and not their date of birth.

“The new notification, in simple terms, means that henceforth having only an EPIC or Aadhaar will be enough a document for any individual to obtain the PAN card.

“These two documents will be valid as the proof an individual’s identity, address and date of birth, thereby reducing the cumbersome procedure of having multiple documents to prove one’s own identity. The EPIC and Aadhaar are now unique and all purpose identifiers,” a senior I-T department officer said.
As part of the new notification, the government has also made a “photo identity card issued by the central government or state government or central public sector undertaking or state public sector undertaking or the central government health service scheme photo card or ex-servicemen contributory health scheme photo card” as the valid proofs for establishing the date of birth of an individual.

“So, effectively now, there are a total of 12 identity documents which could be used to establish the date of birth of an individual who is applying for a PAN card as compared to the eight earlier. But for a common man, who is not in government service, only an EPIC or Aadhaar is required,” the officer explained.

The officer said this new arrangement has been made possible as the government has embarked on a mission to bring the three unique identifiers – EPIC, Aadhaar and PAN – on one platform and have inter-links between their databases in order to thwart attempts of duplicity or forgery in any of these three documents which are the most essential when it comes to taking legitimate benefits of government schemes.

7819 - Now EPIC or Aadhaar document enough to get PAN card - ZEE News

New Delhi: An EPIC or Aadhaar document will now be enough for any individual to obtain PAN card as the Income Tax Department has relaxed the cumbersome procedure of having multiple documents to prove one's own identity.

The Central Board of Direct Taxes (CBDT), the apex policy making body of the I-T Department, has recently issued a notification making the Elector's Photo Identity Card (EPIC) and Aadhaar, issued by the Unique Identification Authority of India, valid proof of "date of birth" for obtaining PAN card.
Till now, both these photo ID cards were only considered as valid proof for substantiating the "identity" and "address" of an individual and not their date of birth.

"The new notification, in simple terms, means that henceforth having only an EPIC or Aadhaar will be enough a document for any individual to obtain the PAN card.

"These two documents will be valid as the proof an individual's identity, address and date of birth, thereby reducing the cumbersome procedure of having multiple documents to prove one's own identity. The EPIC and Aadhaar are now unique and all purpose identifiers," a senior I-T department officer told PTI.
As part of the new notification, the government has also made a "photo identity card issued by the central government or state government or central public sector undertaking or state public sector undertaking or the central government health service scheme photo card or ex-servicemen contributory health scheme photo card" as the valid proofs for establishing the date of birth of an individual.

"So, effectively now, there are a total of 12 identity documents which could be used to establish the date of birth of an individual who is applying for a PAN card as compared to the eight earlier. But for a common man, who is not in government service, only an EPIC or Aadhaar is required," the officer explained.

The officer said this new arrangement has been made possible as the government has embarked on a mission to bring the three unique identifiers - EPIC, Aadhaar and PAN - on one platform and have inter-links between their databases in order to thwart attempts of duplicity or forgery in any of these three documents which are the most essential when it comes to taking legitimate benefits of government schemes.

PAN is a ten-digit alphanumeric number, issued in the form of a laminated card, by the Income Tax Department, to any person who applies for it or to whom the department allots the number without an application.

The EC and the Income Tax Department had recently made announcements that they would be sharing their respective databases and getting on-board with the Aadhaar platform, whose numbers have swelled to 76.83 crore till February 15 this year.

An individual has to apply, either manually or electronically, with copies of proof of identity, address and date of birth along with the application form to obtain a PAN whose government stipulated fee is Rs 105.

The EPIC and Aadhaar fulfil all the three mandatory requirements.

7349 - PAN, Aadhaar card must to avail Telangana education schemes - Deccan Chronicle

DC CORRESPONDENT | February 10, 2015, 02.02 am IST

PAN and Aadhaar cards will be made mandatory for students and parents to be eligible for scholarships.

Hyderabad: PAN and Aadhaar cards will be made mandatory for students and parents to be eligible for scholarships and fee reimbursement to pursue higher education courses in Telangana state. Children of government employees and professionals like doctors, engineers etc., besides private employees drawing reasonable salaries will be barred from the schemes. The TS government has drafted stringent norms to this effect to check bogus beneficiaries.

The Cabinet sub-committee constituted by the government came out with tougher norms to reduce the financial burden on government, which is pegged at Rs 2,500 crore this year. It came to the notice of the committee that the schemes were grossly misused in the undivided state, wherein students from financially well-off backgrounds availed of the benefits causing huge loss to state exchequer. The committee also found that several bogus colleges came up in Telangana since 2009, only to siphon off fee reimbursement funds.

The tougher norms were necessitated as the Telangana State Cabinet had recently decided to continue the fee reimbursement scheme launched by the Congress government in 2008 in toto, against its earlier decision to implement FAST scheme wherein the benefit would be extended to only those students whose ancestors were/are residents of Telangana from before November 1, 1956. The government dropped the FAST proposal after it invited the wrath of the courts, the Opposition parties as well as the students.

The committee has decided in favour of PAN card and Aadhaar as these details will enable the government to ascertain beneficiaries' financial position besides their local, non-local status as per Article 371 (d) of the Constitution. Chief Minister K.Chandrasekhar Rao had announced that Article 371 (d) would be followed to determine the local, non-local status of students and students complying to these local norms would be eligible for the benefits.
