In 2009, I became extremely concerned with the concept of Unique Identity for various reasons. Connected with many like minded highly educated people who were all concerned.
On 18th May 2010, I started this Blog to capture anything and everything I came across on the topic. This blog with its million hits is a testament to my concerns about loss of privacy and fear of the ID being misused and possible Criminal activities it could lead to.
In 2017 the Supreme Court of India gave its verdict after one of the longest hearings on any issue. I did my bit and appealed to the Supreme Court Judges too through an On Line Petition.
In 2019 the Aadhaar Legislation has been revised and passed by the two houses of the Parliament of India making it Legal. I am no Legal Eagle so my Opinion carries no weight except with people opposed to the very concept.
In 2019, this Blog now just captures on a Daily Basis list of Articles Published on anything to do with Aadhaar as obtained from Daily Google Searches and nothing more. Cannot burn the midnight candle any longer.

Legal scholar Usha Ramanathan describes UID as an inverse of sunshine laws like the Right to Information. While the RTI makes the state transparent to the citizen, the UID does the inverse: it makes the citizen transparent to the state, she says.

Good idea gone bad
I have written earlier that UID/Aadhaar was a poorly designed, unreliable and expensive solution to the really good idea of providing national identification for over a billion Indians. My petition contends that UID in its current form violates the right to privacy of a citizen, guaranteed under Article 21 of the Constitution. This is because sensitive biometric and demographic information of citizens are with enrolment agencies, registrars and sub-registrars who have no legal liability for any misuse of this data. This petition has opened up the larger discussion on privacy rights for Indians. The current Article 21 interpretation by the Supreme Court was done decades ago, before the advent of internet and today’s technology and all the new privacy challenges that have arisen as a consequence.

Aadhaar has the potential to transform the financial services industry including banking, insurance, lending, payments, led by services such as e-know your customer and e-Sign, said the Internet and Mobile Association of India, but added that the scheme needs to address the possible misuse of Aadhaar data.

“Conventional paper-based KYC or authentication is a resource intensive process; in terms of time, manpower and operational expenses. For start-ups looking to provide pan-India services, such a compliance burden can be cumbersome and a bottleneck. Estimates suggest that in a paperless platform, financial institutions can reduce costs by 2-3% in banking products and 20-30 percent in insurance products,” said the industry association in a statement on Monday.

The IAMAI is an industry association that counts companies such as Google, Facebook, Microsoft and a host of other Internet-based Indian and foreign companies.

With Aadhaar-based e-KYC and e-Sign, financial service providers will be able to help millions of Indians instantly open savings accounts and give them access to various other financial services like investment, insurance, formal credit, etc, IAMAI said.

“The association is of the view that the biggest impediment to 10X growth of the industry is paper-based verification and authentication process. The association would like to highlight that even a powerful regulator like RBI has shown its lack of confidence on 100 percent e-KYC by mandating paper-based KYC a year after OTP based e-KYC,” said IAMAI.

However, IAMAI also acknowledged the perceived security threats around Aadhaar and the potential misuse of the Aadhaar data.

“IAMAI urges UIDAI (Unique Identification Authority of India) to initiate multi-stakeholder consultation involving the entire digital ecosystem as soon as possible to discuss the issues pertaining to Aadhaar. The association expresses optimism over a collective approach that can help iron out the creases in the near future,” said IAMAI.

Aadhaar, India’s proof of identity project, has been embroiled in controversies ever since its inception. Over the past few months, reports of misuse and unauthorised use of Aadhaar data have surfaced. These claims have been denied by the UIDAI, the agency that administers Aadhaar.

The Supreme Court is also hearing a batch of petitions, some dating back to 2012, that claim that the Aadhaar project scheme violates an individual's fundamental right to privacy.

9612 - Aadhaar enabled e-KYC: Survey says banks, telecom operators can save Rs 10k cr over next 5 years - First Post

With the crucial Aadhaar Bill being passed in the Lok Sabha earlier this week, an international consulting firm in its survey today said that banks and telecom operators can potentially save an estimated Rs 10,000 crore over the next five years by using Aadhaar enabled e-KYC process for customer acquisition.


Besides substantial cost savings for banks and financial institutions by opening bank accounts and registering new customers, Aadhaar enabled e-KYC is significantly more efficient compared to current paper-based KYC, said MicroSave, a development consulting firm, in its survey.

"If e-KYC is adopted for customer on-boarding by banks (for savings bank account opened through branches and alternate channels) and by MNOs (for pre-paid mobility), an estimated Rs 10,000 crore can be saved over the next five years (by 2021)," the study said.

Customer enrolment processes followed by banks also take longer time and it can be two to four weeks before an account is activated. Whereas Aadhaar e-KYC enabled bank accounts can be activated and ready to transact in a few minutes.

After almost a year's standoff with the ministry of home and the Intelligence Bureau (IB), there has been some headway in a proposal to use Aadhaar-based electronic Know Your Customer (KYC) data for allotting mobile telephone SIM cards.

All stakeholders have agreed to conduct a project for testing the efficacy. Based on the findings, a decision will be taken on the way ahead.

According to a government official, an experiment will be conducted in the five circles of Bhopal, Kolkata, Delhi, Lucknow and Bengaluru by telecom operators. These include the state-run BSNL and MTNL, plus private companies Airtel, Vodafone, Reliance and Idea.

Under the proposal, a person would get a new SIM card issued on his or her name instantaneously by punching in the Aadhaar number and biometrics, without needing to present a physical documentary proof. The Unique Identification Authority (UID) servers from the back-end will verify the antecedents.

The Aadhaar letter has been recognised as a valid proof of address and identity for issuing of SIM cards. However, the IB and home ministry had reservations about allowing e-KYC for this. The concern is misuse by terrorists or criminal elements.

The government official said e-KYC was more robust than physical documents. “No one person can own more than nine SIM cards and E-KYC will ensure a way to track the number of SIMs issued on one person’s name, difficult in the case of physical documents.” It has been reported that in one instance, 7,000 SIMs were found to be issued on the basis of one document, the person added.

All major telecom operators involved are pushing the initiative, as e-KYC will save them a significant cost in data storage and verification. The Telecom Regulatory Authority of India imposes heavy fines on operators for not maintaining adequate KYC. They are expected to initially deploy authentication devices in company-owned outlets.

However, another government official said the security concerns were valid. For, SIM cards would be issued on the basis of the address in the Aadhaar database, which in many cases is not correct. “There is an inherent flaw in the database and cases of mixed biometrics and fake identity are being reported.” The person added extreme care needs to be taken in the case of SIM cards. “Bomb blasts are triggered through SIM cards,” the person added. The project is being emphasised since the government's Digital India project seeks to link mobile SIM cards with the UID number.

Earlier, a government official had told Business Standard that a mobile phone number was being considered a medium to act as an identifier for all government schemes. “Till the time a person disputes it, the government will use the number to disburse information about that person's transactions with the government,” the official had said.

New Delhi, December 18: Getting mobile SIM activated for Aadhaar number holders may be a matter of few minutes in the coming days as government has decided launch a pilot project to test UIDAI's electronic-Know-Your-Customer service. Under the Unique Identification Authority of India's e-KYC service, the credentials of a person will be verified online by a service provider like banks or telecom operators on the basis of Aadhaar number and biometric details. At present, it takes at least two day to activate a mobile SIM by a telecom service provider after receiving all required documents and verifications of the customer's credentials. The pilot would be done in the five telecom circles in association with five operators - Airtel (Lucknow), Reliance (Bhopal), Idea (Delhi), Vodafone (Kolkata), BSNL (Banglore), as per a notification of the Department of Telecom. Under the pilot, the customer seeking a mobile connection would have to provide Aadhaar number to the authorised sales agent of a telecom service provider. The agent will online authorise UIDAI by way of biometric authentication using customer's fingers or iris scan to provide his demographic data and UIDAI will provide same in a digitally signed and encrypted format along with Aadhaar number to the telecom service provider. "Once this pilot is successfully implemented, the government can extend this facility in other part of the country," a source said. However, as per the notification, the telecom companies would also continue the existing procedure of verifying the customers' proof of identity and residence. The source said the telecom department is going ahead with the pilot project despite Home Ministry's reservations as the Prime Minister's Office has asked to link mobile SIM with Aadhaar number. The pilot would be launched by the telecom service providers sometime in January. At present UIDAI provides free e-KYC service to the service providers. Telecom companies are also keen to use the facility as they have been paying huge penalties for failing to meet the KYC norms.
