In 2009, I became extremely concerned with the concept of Unique Identity for various reasons. Connected with many like minded highly educated people who were all concerned.
On 18th May 2010, I started this Blog to capture anything and everything I came across on the topic. This blog with its million hits is a testament to my concerns about loss of privacy and fear of the ID being misused and possible Criminal activities it could lead to.
In 2017 the Supreme Court of India gave its verdict after one of the longest hearings on any issue. I did my bit and appealed to the Supreme Court Judges too through an On Line Petition.
In 2019 the Aadhaar Legislation has been revised and passed by the two houses of the Parliament of India making it Legal. I am no Legal Eagle so my Opinion carries no weight except with people opposed to the very concept.

Good idea gone bad
I have written earlier that UID/Aadhaar was a poorly designed, unreliable and expensive solution to the really good idea of providing national identification for over a billion Indians. My petition contends that UID in its current form violates the right to privacy of a citizen, guaranteed under Article 21 of the Constitution. This is because sensitive biometric and demographic information of citizens are with enrolment agencies, registrars and sub-registrars who have no legal liability for any misuse of this data. This petition has opened up the larger discussion on privacy rights for Indians. The current Article 21 interpretation by the Supreme Court was done decades ago, before the advent of internet and today’s technology and all the new privacy challenges that have arisen as a consequence.

New Delhi: A five-judge Constitution bench of the Supreme Court on Friday agreed to hear a writ petition seeking a direction to the Election Commission to link the voter identity card with Aadhaar to remove bogus voters from the electoral list.

A Bench of Chief Justice Dipak Misra and Justices A.M. Kanwilkar and D.Y. Chandrachud told senior counsel V. Krishnamurthy appearing for the petitioner, dissident AIADMK member of Parliament Sasikala Pushpalatha, that he could assist in the hearing before the Constitution bench which is underway and disposed of the petition.

The petitioner submitted that in February 2015 the Election Commission had launched the national electoral rolls purification and authentication programme in the backdrop of duplicate names, multiple entries, and bogus voters in the electoral lists. She said the procedure for deletion of names had not been streamlined and not followed in all the states. It was pointed out that various courts had also expressed concern over defective electoral rolls.

She said it was necessary to bring transparency in the electoral process. Linking the Aadhaar card with voter ID card would result in greater authentication in preparation of final electoral rolls by the Election Commission.

"ID proof may be Aadhaar card when you are using it for all other purposes. It can be used for election also," former Chief Election Commissioner T S Krishnamurthy said.

Former Chief Election Commissioner T S Krishnamurthy today favoured doing away with voter ID card and said Aadhaar can be the sole identity proof for voting.

At present, the Election Commission allows a number of documents, including passport, as identity proof in the absence of voter ID card.

"Today, we are having too many cards leading to so many complications. Don't introduce too many complications in the system. Time has come we should think of only one card, whatever be the card," Krishnamurthy said.

"ID proof may be Aadhaar card when you are using it for all other purposes. It can be used for election also," he said.
"Aadhaar itself can be made as an election ID card. Why do you want to have election ID card as well as Aadhaar? If all voters are covered by Aadhaar, then you should eliminate voter ID card and make Aadhaar the only ID for electoral purposes," Krishnamurthy told .

He said till the entire country is covered by Aadhaar, both the cards should be allowed as ID proof for voting.
"You can set a particular cut-off date, may be 2019 or 2020 or whatever, everybody should have Aadhaar card (for voting)", the former CEC said.

He also said there was no need for the Election Commission to "delink" Himachal Pradesh and Gujarat Assembly polls, and termed it an "avoidable controversy".

Krishnamurthy argued that Himachal Pradesh election could have been postponed by a few days to club it with that in Gujarat.

"I don't know why they should be delinked because it was an avoidable controversy, I thought. There was no need to delink them," the former CEC said.

"When the convention (holding elections to Himachal Pradesh and Gujarat simultaneously) has been so, it could have been easily followed, or even if there was difficulty, the Himachal elections could have been postponed by four or five days," he said.
The EC had on October 12 announced that the Assembly elections in Himachal Pradesh would be held in a single phase on November 9 and the results would be declared on December 18.
The poll panel did not announce the dates for Assembly elections in Gujarat, but Chief Election Commissioner A K Joti had said that the elections will be held before December 18.
On BJP MP Varun Gandhi reportedly terming the poll panel a "toothless tiger", Krishnamurthy said, "There is no power (with the poll panel) to deregister (derecognise parties), but whether it makes it (EC) toothless animal, I don't know."
Gandhi had reportedly said the Election Commission was a "toothless tiger" as it had never derecognised any political party for not submitting poll expenditure details within the stipulated time.
"Yes, there is no power (to derecognise parties), and that power should be available. Law can be amended to say that if you (EC) have power to register, you can deregister a party under certain circumstances," Krishnamurthy added

The apex poll body, which has put mammoth efforts in encouraging 34 crore voters across India to link their Aadhaar (Unique Identification) with the Election Photo Identification Card (EPIC) from March to mid-August this year, will now have to initiate the de-linking exercise.

Supreme Court's ruling on Wednesday — that Aadhaar card can be used only for availing subsidies under the public distribution system and buying kerosene and cooking gas, and that too voluntarily — has jolted the Election Commission of India (ECI).

The apex poll body, which has put mammoth efforts in encouraging 34 crore voters across India to link their Aadhaar (Unique Identification) with the Election Photo Identification Card (EPIC) from March to mid-August this year, will now have to initiate the de-linking exercise.

Maharashtra's chief electoral office said they completed the exercise last month as per the direction of the ECI. "Over 1.8 crore voters in the state had furnished their Aadhaar numbers for seeding with EPIC between March and August. We had started the exercise following the interim SC order on August 11," said a top official.

Under the National Electoral Roll Purification and Authentication Programme (NERPAP), the ECI had launched massive campaigns and newspaper ads across the country for six months, requesting voters to link the two identities.

Over 34 crore voters across the country took the pains and followed the ECI's directives. They are now fuming. "Such haphazard implementation of the scheme frustrates all those who took efforts to follow government directives. Those who ignored are happier now," said Brajesh Sharan, a Mumbai-based banker.

The ECI had hoped to complete linking of voters' ID details with their Aadhaar data by August 15, enabling an error-free electoral roll. It was also looking at a more realistic deadline of 2015-end, while also ruling out 100% coverage.

After a slew of blows to the unique identity or UID programme, the Centre, Reserve Bank of India, stock market watchdog SEBI, telecom regulator TRAI, and a number of states moved the SC for extending the voluntary use of Aadhaar card to other services.

The government's ambitious UID scheme has been challenged in court over privacy concerns because it uses biometric data — fingerprint and iris scans.

Is this the end for Aadhaar for other schemes?

Unlikely. Though the BJP government had opposed the Aadhaar scheme until it was in opposition, the Narendra Modi government has given it a new push since coming to power last year. "For now, the ruling will remain, until a Constitution bench hears the case. The Centre is likely to move court to seek hearing from the larger bench," said a law professor of Mumbai university.

Though the Election Commission had hoped to complete linking of voters' ID details with their Aadhaar data by August 15, enabling an error-free electoral roll, it is now looking at a more realistic deadline of 2015-end while also ruling out 100% coverage. 

With only 34 crore voters having voluntarily furnished their Aadhaar numbers for seeding with EPIC, a senior EC functionary told TOI that the commission was consulting the chief electoral officers of 12 states where the progress has been slow, to review the timeline for the National Electoral Roll Purification and Authentication Programme (NERPAP), launched on March 3 with an August 15 target for completion. 

"The CEOs of these states, including UP and Bihar, have been asked to identify the obstacles to EPIC-Aadhaar linkage, including technology and infrastructure issues, and accordingly indicate a realistic timeline for the project," the EC official said. 


Though the CEOs will formally communicate their "achievable" timelines by the end of this month, indications are that they are looking at a December 31 deadline. "Our goal is to use the Aadhaar-EPIC linkage to weed out errors in the 2016 rolls," the official said. 

For now, the Aadhaar data furnished by 34 crore electors is being processed by the electoral registration officers concerned. EROs will pre-verify the details by matching the Aadhaar number fed by the voter with the UIDAI database. "This process takes time, depending on the wherewithal and systems available at the ERO level. The summary revision for next year's rolls has been announced and we hope to hear from the CEOs concerned by this month-end, on the realistic deadline for NERPAP," the official said.


The EC clarified that the Aadhaar-EPIC seeding exercise was completely voluntary, as per the Supreme Court's directions. "So, as long as a voter chooses to link his Aadhaar number with EPIC, nobody will be able to misuse his voter ID for impersonation or bogus voting," the official said.

The countrywide drive to link Aadhaar with voter ID cards has become a political slugfest in Hyderabad, amid talks that names of nearly 28 lakh citizens will be struck off electoral rolls for reasons ranging from migration to multiple enrolments. 

The Greater Hyderabad Municipal Corporation will go to polls in about two months. About 73.54 lakh people live within its limits. 

A survey carried out by the Telangana Election Commission threw up the numbers, which are being contested by opposition parties. The massive drive was undertaken after Chief Minister K Chandrasekhara Rao (pictured) asked Chief Electoral Officer Bhanwarlal to ensure 100 per cent voter card-Aadhaar linkage. 

This being the first civic polls for the ruling TRS, opposition parties have accused KCR of orchestrating a move to exclude Andhraites living in Hyderabad from the municipal election. Marri Sasidhar Reddy, ex-chief of the National Disaster Management Agency, said the government intentionally chose some pockets that have a large population of Andhraites. 

TDP's Telangana unit president L Ramana has petitioned the CEO, alleging that voters originally hailing from AP have been deleted without verification. 

TRS leader Padmakar justified the move saying about 15 lakh people had returned to Andhra following the bifurcation. "Hence, their votes would become invalid here." 


CEO Bhanwarlal said no genuine voter will suffer. "People with multiple voter ID cards can decide which one to retain. Their names will be deleted from the other rolls."

The political representatives will be given the list of voters whose doors were locked or who had shifted their residences and could not be seeded. The political parties have been asked to get their booth-level leaders to complete the verification. The voters, whose names are left out, will be removed from the voters list as per the directions of the Election Commission.

PUNE: Many voters in the city and rural parts of Pune have not yet linked their Aadhaar number to voter identity cards. Of the 67 lakh voters in Pune district, only 10 lakh voters have submitted details to the administration in the special drive carried out in the last three months.

The poor response has prompted the administration to change its strategy. Now, booth-level officers (BLOs) will go door-to-door on Sunday to collect Aadhaar details from voters, in their respective areas, who have not submitted the information yet.

An official from the district election branch said, "The ongoing drive will end on July 31. We were expecting voters to come out on their own and submit the details. However, the response has been very poor. Only 10 lakh voters have given the details so far. The election commission has also given two more options to upload details — uploading information via SMS and through a website. These two processes also have got poor response."


The official said that the drive aims to authenticate the electoral roll by removing names that are repeating. The administration had not deleted names from the list in 2014 being an election year. By getting rid of the duplication, the administration will get the real statistics of voters in every assembly constituency.

Sources said that the administration had set a target of linking Aadhaar details and voter IDs of 80% of the voters. Special drives were held on Sundays to help voters to submit applications at polling stations but the turnout remained very low.

Meanwhile, the administration has taken up steps for uploading of information received through 10 lakh forms. Authorities have already uploaded details of about 2.30 lakh forms, while the remaining work will be done by next month. There are about 67 lakh voters spread in 21 assembly constituencies in Pune, of which 11 are in urban and 10 in rural parts.

About 80% people in the district have secured Aadhaar number so far. Efforts are being taken to increase the enrollment.

13,081 names deleted from electoral roll:

As many as 13,081 names of voters have been deleted from the electoral roll for reasons like death and duplication. Names were deleted after conducting panchanamas and completion of necessary procedures. Authorities said that they have listed more names for deletion. The block-level officers have been conducting panchanamas and verifying voters' addresses. The drive will continue on Sunday. Names will be removed if the people are not staying at the given addresses or in case of death, said the authorities.

The Secunderabad Cantonment Board (SCB) is racing against time. With just a day to go for the completion of the linking the unique identification (Aadhaar) numbers with voter identity cards, only 70,000 of the 2,58,371 lakh voters have submitted applications so far, officials from the election branch said.

The Aadhaar-voter ID linkage process stared in the Secunderabad Cantonment on May 12 and the target to complete is June 30. Officials say that the deadline will now have to be extended. On an average, about 20 people visit the cantonment to get their Aadhaar numbers linked to their voter identity cards. 

Due to the lukewarm response, the officials have decided to go to the colonies and meet residential apartments and colony secretaries and also plan for announcements through banners and mike. K Lakshmi, deputy tehsildar, elections, SCB, said that the awareness programme would start with Ward 1 and continue till all the wards are covered.

The lack of house numbers in the cantonment is cited as the major reason for not completing the linkage process on time rue Booth Level Officers. There are 249 booth level officers on the job and only those who are covering the areas that fall under the GHMC area have no problems in tracing the houses as there is house number. 

D V Srinivas, a BLO said that there are 43 polling stations that come under the GHMC area such as Rezimental Bazaar, Shivaji Nagar and West and East Marredpally. The voters pay their taxes to the GHMC but fall under the Cantonment constituency.

The target given to the BLOs is to complete 200 houses but are able to trace just 50 houses a day. The lack of a house numbers and with no landmarks to find their way, the BLOs are not able to meet their targets. Lakshmi says that the sanitation and water department workers from the SCB are helping the staff to find the houses.

In comparison to other areas, the cantonment is posing a major problem for the BLOs. A senior official of the election branch said that in most areas the door is locked as both husband and wife work.

With just a month left for linking Aadhaar numbers with voter ID cards, Pune district has received only 2.33 lakh applications and have linked Rs 93,000 names, according to data. A special drive on Sunday helped to increase these numbers.
The drive was conducted at all electoral booths by Booth Level Officers (BLOs). Camps were held at BLO offices as well as at the Council hall.

“The final figures after the special drive are yet to be collated”, said deputy election officer Samiksha Chandrakar Gokule.

PUNE: Only 2.33 lakh of the 69 lakh voters in the district have submitted applications to link their unique identification (Aadhaar) numbers to their voter identity cards so far, officials from the district election branch said.

Since last month, the district election office has initiated a drive to assist voters to link their Aadhaar number. However, with less than 4% voters having submitted their details, the administration now faces an uphill task to meet the target of maximum enrolment in the next one month.

A senior official from the election branch said, "The initiative has not received the expected response. We have appealed to voters to submit their Aadhaar details by following a simple procedure. Voters only have to visit the nearest polling station with a photocopy of their Aadhaar cards. Even if they don't have a voter ID card, they can submit the Aadhaar details to the election officials."


People can also upload their details online, by logging onto the national voters' service portal. The website provides a mobile number for further assistance.

The administration has also announced a daylong drive on Sunday for voters to submit Aadhaar details at their nearest polling station between 10am and 5pm. A similar facility will also be available at the offices of returning officers of the respective assembly constituencies.

Such a drive was conducted in May and will also be taken up in July, officials said. As per the latest report, of the 2.33 lakh applications received so far, the administration has uploaded details of 93,000 voters.

Apparently, the postman who was responsible to deliver the cards to Nayak and others in villages around Halol decided instead to dump and destroy them.


Sunil Nayak may have waited for around fourteen months now for his Aadhaar card to be delivered to his village address at Ghansar Muvadi in Halol taluka of Panchmahals district, little knowing that his unique identification card was dumped apparently by the postman who was supposed to deliver it to his address.

Nayak’s card, which was issued on April 18, 2014, was one of the thirty eight such Aadhaar cards that were dumped in a farm land at Dhansar village in Halol before being delivered. Locals spotted the dump of Aadhaar cards on Monday evening and informed the mamlatdar office.

Apparently, the postman who was responsible to deliver the cards to Nayak and others in villages around Halol decided instead to dump and destroy them. Panchmahals collector and Superintendent of Post Offices in Godhra on Tuesday initiated inquiry into the matter.

Collector P Bharthi said that she has talked to the Postmaster General of Vadodara region about complaints that she has received from villagers regarding their Aadhaar cards having not been delivered to them months after getting issued. Aadhaar cards are delivered by the India Post.

Bharthi said that the district administration has also offered help to the Postmaster General regarding delivery of the cards using local administration mechanism in case the postmen found it hard to reach the address given in the cards. Several cards are being lost while being delivered, she said.

“We have initiated an inquiry headed by the SDM. We have also talked to the Postmaster General of Vadodara region regarding a lot of complaints that we have received from villagers that their Aadhaar cards have not reached them. A lot of people have not received their cards. We have offered support to the India Post in delivering the cards in case they found the address difficult to access,” she said.

Superintendent of Post Offices, Godhra, AB Jadhav said that an inquiry has been launched by the postal department and the postman responsible for the dump will be suspended for dereliction of duty.

“The inspector of Halol post office has visited the site where the cards were dumped and an inquiry is on in the matter. Action will be taken against the postman who would have thrown away the cards. The postman is being identified,” Jadhav said. Centre has recently decided to link a parson’s Aadhaar cards to several government schemes such as to the bank accounts being opened under the PM’s Jan Dhan Yojana and subsidized LPG gas, other than to the voter ID.

8042 - Aadhaar Seeding to Voter ID - New Indian Express

SRIKAKULAM:  Chief electoral officer Bhanwar Lal directed the district administration to complete 100 per cent seeding of voter ID cards with the Aadhaar number by August 1. The CEO held a rivew meeting with various political leaders and election officers in the district Sunday.

He made it clear that the election officers have to ensure to visit every house to link the voter ID card with the Aadhaar card.

He said that there were about 10,000 bogus voters identified in the district. Collector P Lakshmi Nrusimham explained the progress of Aadhaar seeding with the voter ID card.
