In 2017 the Supreme Court of India gave its verdict after one of the longest hearings on any issue. I did my bit and appealed to the Supreme Court Judges too through an On Line Petition.
In 2019 the Aadhaar Legislation has been revised and passed by the two houses of the Parliament of India making it Legal. I am no Legal Eagle so my Opinion carries no weight except with people opposed to the very concept.

Good idea gone bad
I have written earlier that UID/Aadhaar was a poorly designed, unreliable and expensive solution to the really good idea of providing national identification for over a billion Indians. My petition contends that UID in its current form violates the right to privacy of a citizen, guaranteed under Article 21 of the Constitution. This is because sensitive biometric and demographic information of citizens are with enrolment agencies, registrars and sub-registrars who have no legal liability for any misuse of this data. This petition has opened up the larger discussion on privacy rights for Indians. The current Article 21 interpretation by the Supreme Court was done decades ago, before the advent of internet and today’s technology and all the new privacy challenges that have arisen as a consequence.

New Delhi, May 4 () Linking Aadhaar with ration cards has resulted in a huge saving of Rs 14,000 crore for the exchequer, Union Minister Ram Vilas Paswan said today.

"Eighteen crore ration cards have been linked to Aadhaar cards in the country. This has resulted in savings of Rs 14,000 crore due to weeding out of bogus ration cards," the Food Minister said at the India Integrated Transport & Logistics Summit 2017 here.
The government, he said, aims to computerise the Public Distribution System to help check pilferages and plug leakages by installing electronic Point of Sale (ePoS) devices at all fair price shops.
"There are a total of 5.22 lakh fair price shops across the country," he said.
Procurement, storage and distribution of agricultural produce need proper and efficient logistics system to plug leakages, avoid rotting of grains and other perishable items and timely transport of the produce to the market, he said.

There is a need to develop a National Common Market, Paswan added.
He said connectivity between rail, road and waterways are required, so that farmers can take their produce to market in time and get better price.
The minister said there is an impressive growth in sectors like roads, waterways, aviation and railways.
Addressing the inaugural session, Minister for Skill Development Rajiv Pratap Rudy said with all infrastructure and logistics development the need to develop skills of man power is also required.
The employment seeker will need proper training for this area, he said, adding that with the transport and logistics sector poised for a makeover, a lot of new jobs are likely to become available.
He emphasised the need to train the youth to make the best of these upcoming opportunities.
The Minister of State for Road Transport & Highways and Shipping Mansukh L Mandaviya stressed upon the need for an integrated approach for development of multi modal transport.
He said the government is also working on alternatives for cargo movement from road to inland waterways and rail. He said the mission of the government is to bring down carbon emission to 10 per cent. NAM RAM NKD SA

New Delhi: With Tamil Nadu and Kerala on board, all 36 states and Union territories (UTs) in India have implemented the National Food Security Act (NFSA), food minister Ram Vilas Paswan said on Thursday.
“Only 11 states had implemented the Act when we came to power (in 2014),” Paswan said, adding that the next goal of the centre is to complete linking ration cards with Aadhaar unique identification numbers. So far, 71% of ration cards have been linked with Aadhaar numbers to ensure transparency and reduce leakages, he said.
Through various measures like digitization, 26.2 million bogus ration cards have been weeded out and currently the leakage of grains stands at a mere 0.04%, Paswan said.
Enacted by Parliament in 2013, NFSA entitles 50% of the urban and 75% of the rural population to highly subsidized foodgrains at Rs2-3 per kg. Each eligible person is allowed to draw 5 kg of grains per month.
So far, 800 million Indians have been enrolled under the scheme, close to the intended coverage of 813.4 million under the NFSA, the food ministry said in a statement. It added that the program entails a subsidy outgo of Rs1.4 trillion per year, making it the largest welfare program run by the centre.
According to the food ministry, the beneficiary database has been digitized in all 36 states and UTs. 28 states and UTs are allocating beneficiaries their share of foodgrains online, and the entire foodgrain supply chain has been computerized in 18 states and UTs.
To prevent leakage of foodgrains, the centre has initiated two models. Under the direct cash transfer model, the beneficiary gets the money into the bank account and purchases grains from market. The UTs of Chandigarh, Puducherry and urban areas of Dadra and Nagar Haveli have opted for this.
Under the second model, currently used by all states, foodgrains are distributed through an electronic point of sale (e-PoS) device. The device authenticates beneficiaries during distribution of grains and also electronically records the amount of grains distributed to the family.
According to the food ministry, currently 1,61,854 fair price shops are using the e-PoS device.

New Delhi: Union food minister Ram Vilas Paswan said on Friday that 100% beneficiary ration cards under food subsidy programme have been digitized so far, but only 65% have been seeded with the Aadhaar card due to slow performance by some states.

“While all ration cards have been digitized in the country, some states are slow in seeding them with Aadhaar card, which would help in eliminating bogus beneficiaries, Paswan said, urging the states to move faster. He added that 2.33 crore ration cards have been deleted in 27 states weeding out bogus beneficiaries.
Paswan was addressing a gathering of state food secretaries in the national capital to review the performance of the targeted public distribution system (TPDS), India’s largest subsidy programme with an annual outgo of more than Rs.1.35 lakh crore.

To cut down on leakage of foodgrains, the Centre is using the Aadhaar unique identity number and focusing on end-to-end computerization of TPDS, as mandated under the National Food Security Act (NFSA), 2013.

As per the NFSA, the Centre provides subsidized grains to about 67% of households at a rate of between Rs.1 and Rs.3 per Kg.
Paswan said that the ministry has given an ultimatum to two states, Kerala and Tamil Nadu on implementing the NFSA Act at the earliest.

“If the two states do not implement, we will take stringent action. One option we have is to supply APL (above poverty line) foodgrains to them at a higher rate or we completely stop the allocation. Let them buy foodgrains for APL families at the support price,” he said.

C.R. Chaudhary, minister of state for consumer affairs, food and public distribution, urged the states to focus on timely procurement and disbursal of subsidies. “ States should go for scientific storage and all information regarding godowns must be computerized,” he said.

Lack of information was another major issue that came up for discussion. “States must display all information on their portal, right from the number of Aadhaar enrolments done to ration cards seeded with Aadhaar,” said Vrinda Swarup, food secretary.

According to a background note prepared by the food ministry, seeding of ration cards needs to be expedited in 19 states and union territories.

While Bihar, Assam and some north-eastern states have shown no initiative with less than 1% Aadhar seeding of ration cards, Andhra Pradesh, Chhattisgarh, Rajasthan and Telangana have completed the process.

With more than 90% of ration cards seeded with Aadhar, the process is nearing completion in Himachal Pradesh, Jharkhand, Karnataka, Kerala, Punjab, Tripura and Uttarakhand.

In eight states the progress is between 50% to 80%. These include Gujarat, Jammu & Kashmir, Madhya Pradesh, Odisha, Sikkim, Uttar Pradesh and West Bengal. In Arunachal Pradesh and Tamil Nadu, the process is in initial states with seeding rate between 30% to 50%.

The note from the food ministry shows that so far 8.9 lakh beneficiaries in three union territories—Chandigarh, Puducherry, and Dadra and Nagar Haveli—are availing direct cash transfer of food subsidy.

Andhra Pradesh is the first State in the country to automate all its 29,027 fair price shops (FPS), followed by Madhya Pradesh (all 22,401 FPSs), Daman & Diu (all 51 FPSs), and Tamil Nadu (all 34,723 FPSs).

Considerable progress has also been achieved in Gujarat, Chhattisgarh and Rajasthan with 17,000 (99 per cent), 11,965 (97 per cent) and 24,649 (96 per cent) automated FPS, respectively, the Food Ministry said, adding that this had resulted in reduce ghost-lifting and better targeting of food subsidies.

Addressing a National Conference on Reforms in PDS here on Friday, Food Minister Ram Vilas Paswan also said that as on date, 64.86 per cent (15.74 crore of 24.27 crore) ration cards had been seeded with Aadhaar.

Due to Aadhaar seeding, 33 crore ghost/fraudulent/duplicate ration cards had been deleted across 27 States and Union territories, which had led to estimated ‘rightful targeting of food subsidies’ of ₹14,000 crore, he said.
Requesting other States to expedite reforms in the public distribution system (PDS), a key feature of the National Food Security Act (NFSA) being implemented in 34 States/UTs, Paswan requested Kerala and Tamil Nadu to also implement the Act “as early as possible.”
The CEO of Unique Identification Authority of India, informed the conference that Section 7 of Aadhaar Act had been notified and made operational with effect from September 12, 2016. He briefed the gathering on the implications of Section 7 and 12 of Aadhaar Act that requires Aadhaar authentication on possession of Aadhaar for availing subsidy from Consolidated Fund of India.
“Those who do not have Aadhaar will be required to enroll for it. Departments can also provide for alternate methods of identification, so that no beneficiary is denied the benefit from government schemes in the interim,” the Ministry said.

The Union Minister also stressed on the importance and role digitisation played in automating 1.5 lakh fair price shops. He urged states to expedite reforms.

As on March 31, 2015, there were 11 crore households with public distribution system (PDS) ration cards.

Food security activists and economists have expressed concern at the exclusion of thousands of PDS beneficiaries in Rajasthan owing to glitches in the Aadhaar enabled electronic Point of Sale (ePoS) device.

The Aadhaar enabled ePoS is dealing a double blow to the state’s public distribution system, leaving out beneficiaries owing to glitches in the ePoS machine, and not being able to check “quantity fraud”, activists maintain.

The Rajasthan government, however, has said the state’s record has been exemplary in making the transition from the older ration card-based system to the one based on biometric identification using Aadhaar.

Interestingly, Subodh Agarwal, Principal Secretary (Food and Civil Supplies) cited Rajasthan’s Aadhaar ePoS experiment as a “best practice” at a meeting in New Delhi on Friday. 

“Rajasthan’s experience has been exemplary due to the speed at which we have done Aadhaar seeding, National Food Security Act sanitisation as well as ePoS installations,” he told The Indian Express.

In a letter to Union Food and Public Distribution Minister Ram Vilas Paswan, activists and economists, including Jean Drèze, Reetika Khera, Nikhil Dey and Anjali Bharadwaj, have sought to draw the government’s attention to the “danger of inappropriate technologies” for PDS in states like Rajasthan and Jharkhand.
According to data obtained from Rajasthan government’s official portal, only 64 per cent beneficiaries were getting their ration through the Aadhaar enabled ePoS system in August.

The remaining 36 per cent are vulnerable to exclusion owing to glitches in the machines, allege activists.

While the number of beneficiaries has seen an increase — from 44.6 per cent in May to 64 per cent in August — activists say the numbers still present a bleak picture.

“A 62 per cent ‘success’ rate (July) is disastrous. In rural areas at least, hardly anyone foregoes their rations. We don’t know what is happening to the remaining 38 per cent. There is no clarity about a ‘manual override’ facility, that is if the machine fails you, the dealer can revert to old-style register-based sales. In any case, dealers have no incentive to tell people about. Are the 38 per cent aware of the manual override facility, or are they being cheated?” said economist Reetika Khera.

“The new technology has possibly dealt a double blow – quantity theft continues as before; plus for 38 per cent, they may get it if they know about the possibility of register based sales, or not at all if they are unaware of this option,” she said.
However, the state government says the system cannot result in exclusion. “We are not saying that ePoS machines cover 100 per cent beneficiaries. But those who can’t get their ration from ePoS due to some technical glitches, can always get it from the manual system,” Subodh Agarwal, Principal Secretary (Food and Civil Supplies), told The Indian Express. “And the system is slowly picking up. If we have reached over 62 per cent from 44 per cent in May, then that is an achievement,” he said.

Aas Mohammad, a Fair Price Shop operator in Tijara, Alwar, said all sales at his shop were being made using ePoS machines. “If the machine fails to identify them, they have to come again. We have stopped selling through registers,” he said.

In the last two years of the NDA government, the focus has been on reforming the public distribution system (PDS) through measures such as digitalisation and Aadhaar-seeding of ration cards and linking of the Food Corporation of India (FCI) godowns through an online platform. These measures have led to weeding out of more than a crore fake ration cards. Union minister of food and public distribution Ram Vilas Paswan spoke to Sandip Das on the wide range of issues concerning his ministry. Edited excerpts:

Q: In the last two years, how much has been the progress in terms of PDS reforms?
When we took over, only 11 states had rolled out the National Food Security Act (NFSA). At that time, the work related to digitisation of ration cards or their seeding with Aadhaar or online allocation of foodgrain to states, computerisation of supply chain management etc, were not initiated. The 11 states, just out of political compulsion, had launched the NFSA to garner votes in the 2014 elections. The Act was rolled out in these 11 states just to show that grains are being distributed at Rs 3 per kg for rice, Rs 2 per kg for wheat and Rs 1 for coarse cereals, and nothing was there in the name of reforming the PDS.
When we took over in 2014, only 2% of the ration cards were seeded with Aadhaar. Today, it has risen to 53.04% as on April 19, 2016. Now, if you go by state-wise progress, states and UTs like Andhra Pradesh, Chhattisgarh, Rajasthan, Telangana and Chandigarh have seeded all their ration cards with Aadhaar. I want to stress that no state has achieved less than 50% Aadhaar seeding of ration cards with the exception of UP and Bihar. In Bihar, Aadhaar seeding is just 0.06% and in Uttar Pradesh, it’s only 37.82%. The worst performer is Bihar, which is also among the poorest state in the country.

Similarly, online foodgrain allocation was on in nine states, today it has risen to 26 states, supply chain was computerised just in four states, but today, almost 15 states have computerised supply chains. Besides, Direct Benefit Transfer (DBT) in PDS was not there, but now it has been started in UTs — Puducherry, Chandigarh and the urban areas of Dadra and Nagar Haveli. The FCI’s depot online was not initiated then, but by July 2016, all the 550 FCI depots would be come under an online platform.

Q: What is the progress in terms of modernising PDS outlets and what is the vision for the next three years?
The electronic point of sale (e-Pos) devices was there in just 5,835 ration shops as on May 2014, but as of April 24, 2016, it has increased to 1,01,435 shops. Bend of March 2017, e-Pos will be set up in 3,00,000 shops and by 2019, all the 50,00,000 ration shops in the country would be connected through point of sale devices except may be in some hilly areas.

Q: Could the better implementation of NFSA in states such as Uttar Pradesh and Bihar have prevented some of the reported hunger-related deaths in these states?
It’s the state’s responsibility to identify vulnerable and poor families to be covered under the NFSA and the Centre’s task is to fix criteria about percentage of population to be covered in the urban and rural areas. Had the states done the identification properly even under NFSA, no poor would have been left out of the mega food security scheme. There will be no starvation death due to Centre’s laxity. Still, if there are starvation deaths despite the NFSA being implemented, it means the concerned state government is incompetent and the entire onus lies with them.
Doubts are being raised that the government is unlikely to meet the wheat procurement target of 28 million tonne for the 2016-17 rabi procurement season?
We are keeping a close watch on the situation, but whether we can meet the target will be known in few weeks’ time, but any drop in procurement would not impact our PDS distribution and the retail prices would not go up as we have more than adequate wheat stocks with FCI.

The spike in price of pulses remains a worry for inflation managers. What are the measures the government is taking to deal with the situation?
On pulses, I have very clearly said if pulses’ prices rise, it would be responsibility of the state government. I can accept the pulses prices (specially urad and arhar) till Rs 120 per kg, but if there is a price increase beyond Rs 120 a kg, it will be the responsibility of the state government, as we have already directed states to give their requirement of pulses which we will provide from our buffer stock. States also have a role to play in growing pulses. We have also tightened the noose around importers and directed the revenue department to take strict action against hoarders.

What about the recent issues concerning Punjab’s PDS system which led to delays in banks providing cash credit limit to the state? What are the steps being taken to resolve the issue?
I won’t go into the quantity (of amount payable to Punjab from FCI), but would only deal with the policy part of this. The Centre pays Punjab in two ways— one is through the Minimum Support Price (MSP), which is paid immediately and there is no dues from any state on that front. The second expenditure relates to transportation and other incidentals. In it, we pay 90% of the expenditure immediately which includes that for gunny bags etc, the entire problem is of the remaining 10%. We are trying to sort this out and have held discussion with the states and also in the PMO. As far as dealing with the banks is concern, the Centre can’t intervene in that.

As many as 10 States are set to implement National Food Security Act (NFSA) from April 1, taking the total number of States covered under the subsidized food scheme to 21.
“From April 1, 10 States, including Gujarat, are going to launch the food security programme and all preparations for the smooth launch have been made,” said Union Food and Civil Supply Minister Ram Vilas Paswan in Ahmedabad on Monday.
The Minister held a review meeting with the officials of the Gujarat government and Food Corporation of India (FCI) on how the subsidized food programme was being launched in the State.

“When I took over as Minister, only 11 States had implemented the programme and in those States also, there were many issues and challenges. We have worked towards sorting out the issues and now more and more States are joining,” Mr. Paswan said.

In the last two years, the Centre and the States have worked for digitization, linking ration cards with Aadhaar, computerization of PDS shops and supply chain network, which are required to implement the act nationally.

“Of the 24.18 crore ration cards in the country, almost 99 per cent have been digitized while 48 per cent have been linked with Aadhaar cards,” the Minister said.

Union Minister of Consumer Affairs, Food and Public Distribution Ram Vilas Paswan said the NFSA will be implemented by the remaining six states in April, ration cards will be linked to Aadhar cards and so on, but he went on to concede that there were several complaints of irregularities in implementation and the centre can do very little about these things. 

It is up to the state government to check corruption and ensure that the poor get the benefit as the objective of the NFSA is to check bogus cards and beneficiaries and plug loopholes in distribution. 

Implicitly taking a dig at the state government, he said, “They claim to provide rice free of cost or at Rs.1 per kg. The message given is that the state government is doing so whereas the fact is that the central subsidy is Rs.27 per kg and the state subsidy is barely Rs.2 or Rs.1 per kg. 

“In a federal structure, the centre cannot intervene on matters pertaining to digitised ration cards being issued to ineligible people, of the Food Commission, vigilance committees etc not being formed etc. But we will certainly forward all such complaints to the state government,” he said. 

Asked what action would be taken if the six states which are yet to implement the NFSA are unable to meet the April deadline, Paswan said the matter is pending disposal of the apex court. 
What can the centre to at the most it can stop supply of food grains, but then the people will suffer, he observed while insisting that the role of the centre ends at the FCI godown. 
It is the responsibility of the state government to ensure proper distribution to genuine beneficiaries, he added. 

Highlighting the achievements of his ministry, he said, “99.9 per cent of ration cards ( with the exception of two districts in Himachal Pradesh) have been digitized. Over 42 per cent of the ration cards have been even linked with Aadhaar cards and point of sale devices to keep electronic record of allocation to the beneficiary have been installed in over 77,000 ration shops.”

He said during the ongoing khareef season huge paddy procurement of 261.37 lakh tone has been procured till Thursday. Direct Cash Transfer of food subsidy to beneficiaries has been launched in Chandigarh and Puducherry on an experimental basis since September last year, he noted. 
He said steps to create a 1.5 lakh metric tonne buffer stock of pulses has been planned and FCI has started procurement operations. 

The drop in international prices of imported oils was affecting prices of domestically produced edible oils, he said adding that the import duty on such items had been increased to protect the farmer. 

Reform measures have been introduced in FCI and it has been asked to construct modern silos for storage of 100 lakh MT capacity at different locations on PPP mode. 

A time bound construction plan has been put in place, stated Paswan. 

Despite the deficit monsoon over the last two years, there is more than adequate foodgrain stock, he said.

For the first time ever, all the ration cards in India are digitised, food minister Ram Vilas Paswan said.

Addressing a meeting in Bhubaneswar today, Paswan said that 42% of the digitised ration cards are linked to Aadhaar cards.

In total, around 77,000 ration shops across the country have automatic point of sale devices installed, he said, all of which will help in checking leakage and pilferage of food grains distributed through public distribution system.

7493 - Seed Aadhaar in PDS beneficiaries database: Paswan to states - Economic Times

NEW DELHI: Centre has asked states and UTs to link the beneficiaries database of public distribution system with the Aadhaar number to de-duplicate the data, Parliament was informed today.

Under the Plan scheme on end-to-end computerisation of Targeted Public Distribution System (TPDS), states/UTs are interalia required to digitise their ration card/beneficiaries database, Food Minister Ram Vilas Paswan said while replying to a question in the Lok Sabha.

"With a view to de-duplicate the beneficiaries database, States/Uts have also been requested to seed 'Aadhaar' numbers in digitised database," Paswan said.

Replying to a separate question, Minister of State for Food Raosaheb Patil Danve also said that a scheme on end-to-end computerisation of TPDS, with a total approved cost of Rs 884.07 crore is being implemented throughout the country.


The government has so far released an amount of Rs 257.01 crore under this scheme to states, National Informatics Centre and consultancy services.
